1. About these terms

These Terms & Conditions govern your use of the Nouriti Café website and services ("Service") operated by Nouriti Café, 47 Florida Road, Windermere, Durban, 4001, South Africa ("we", "us", "our").

By registering an account or placing an order you confirm that you have read, understood, and agreed to these terms in full. If you do not agree, please do not use the Service.

2. The Service

Nouriti Café provides chef-curated weekly meal plans for lunch and/or dinner, available for delivery to selected Durban suburbs or collection from designated pick-up points. Menus are published weekly and are subject to change based on ingredient availability.

3. Orders and cutoff times

  • Orders for each week's menu close on Sunday at 08:00. No orders can be placed or modified after this time.
  • Once an order is placed and paid, it is confirmed. Cancellations after Sunday 08:00 are not possible as production planning begins immediately.
  • If a specific ingredient is unavailable after your order is placed, we will substitute with an equivalent item of equal or greater value and notify you by email.
  • We reserve the right to close specific days due to public holidays or kitchen closures. Affected customers will be notified in advance and billing will be adjusted accordingly.

4. Pricing and payment

  • All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
  • A flat delivery fee of R35.00 applies per delivery order. Collection orders have no delivery fee.
  • Payment is processed securely through PayFast. We do not store card details.
  • Your order is only confirmed once payment is successfully received. Unpaid orders may be cancelled automatically.
  • Prices are reviewed periodically and may change between weekly menus. The price shown at checkout is the price you will pay.

5. Subscriptions

  • Subscriptions auto-renew each week and generate a new order and payment request.
  • You may pause or cancel your subscription at any time from your account dashboard, provided you do so before Sunday 08:00 cutoff for the upcoming week.
  • Pausing or cancelling after the cutoff will take effect from the following week.
  • We are not liable for automatic renewals that occur because you failed to cancel before the cutoff time.

6. Delivery

  • Delivery is available to Durban suburbs listed on our website. Delivery zones may be updated from time to time.
  • Estimated delivery windows are provided on a best-effort basis. We are not liable for delays caused by traffic, weather, or other circumstances outside our control.
  • It is your responsibility to provide a correct and accessible delivery address. Failed deliveries due to incorrect addresses may not be refunded.
  • Meals are prepared fresh and must be refrigerated upon receipt. We are not responsible for food quality if meals are left unrefrigerated after delivery.

7. Allergens and dietary requirements

Our kitchen handles common allergens including nuts, gluten, dairy, and eggs. While we take reasonable precautions, we cannot guarantee that any meal is completely free from traces of allergens. If you have a severe allergy, please contact us before ordering. The exclusion feature removes named ingredients from your meal but cross-contamination in the kitchen environment cannot be guaranteed.

8. Refunds and complaints

  • If your meal arrives damaged, incorrect, or of unsatisfactory quality, please contact us within 24 hours of delivery with a photo and description.
  • We will offer a replacement, credit, or refund at our discretion depending on the nature of the issue.
  • Refunds are processed back to the original payment method within 5–7 business days.
  • We do not offer refunds for orders where the cutoff has passed and production has begun.

9. Your account

  • You are responsible for maintaining the security of your account credentials.
  • You must be 18 years or older to create an account and place orders.
  • We reserve the right to suspend or terminate accounts that are used fraudulently or in violation of these terms.

10. Intellectual property

All content on this website — including recipes, menus, photographs, and branding — is the property of Nouriti Café and may not be reproduced without written permission.

11. Limitation of liability

To the maximum extent permitted by South African law, Nouriti Café's liability for any claim arising from the use of the Service is limited to the amount paid for the specific order giving rise to the claim.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the courts of KwaZulu-Natal.
